Swapandstay.com specifies these Terms and Conditions in the interest of protecting members and their holiday homes to the best of their abilities.

By clicking on the ŽI agree to the terms and conditions of membership` button on the membership application and paying your yearly membership fee, you are agreeing to the following terms and conditions. As a member, every time you login you are agreeing to the guidelines of behaviour and should act accordingly when you contact other members.

Terms of use

Swapandstay.com is a 'members only' contact site that provides the means for holiday home owners wishing to swap holiday homes to contact each other in order to make the necessary arrangements required to swap holiday homes for a set period of time.

Membership is only available to owners of holiday homes.

Holiday homes, vacation homes, yachts, mobile homes and static caravans, are all eligible for membership of Swapandstay.com.

Primary homes and time-share properties are not eligible for membership of Swapandstay.com. Any member who has joined with properties that do not qualify for membership will have their membership revoked.

Membership is limited to the registered owner(s) of the holiday home property.

Swapandstay.com charges a yearly membership fee of £25 GBP. This entitles the member to 12 months of ' unlimited swapping'. Membership runs for 12 months from the date of joining. A renewal reminder will automatically be sent by email.

Your property will appear on Swapandstay.com under the country and location specified, displaying the text and photographs that you provide.

Once an account has been set up and activated refunds will not be granted.

Swapandstay.com reserves the right to refuse membership to any property owner for any reason.

All properties MUST meet the specification and description of the property as listed on Swapandstay.com.

Both holiday home owners involved in the swap are responsible for all transactions pertaining to the swapping of their holiday homes. Any financial reimbursements will be the sole responsibility of the members concerned.

Members can cancel their Swapandstay.com membership at any time before the expiration date. However, Swapandstay.com operates a no refund policy.

Swapandstay.com reserves the right to use text or photos from property listings, the forum and testimonials for promotional marketing purposes only.

Swapandstay.com will never give out personal member information to anyone for any purpose.

Swapandstay.com reserves the right to cancel a property owner's membership should the member use inappropriate text or pictures in their property listing. This also applies to the member's forum area of the site and any personal website of said member. No refunds will be made to the member in this instance.

Links to members' own websites pertaining to the property advertised will be permitted. All others will be removed.

Swapandstay.com reserves the right to remove any information, which in our opinion is not deemed suitable or relevant to holiday home swapping.

Your Swapandstay.com membership will commence on the date we receive your membership payment and acceptance of the terms and conditions.

The accuracy of the information in member's property listings is the sole responsibility of the member and has not been verified by Swapandstay.com. Accordingly, Swapandstay.com makes no guarantee as to the accuracy of the information contained within the member's property listing.

• Swapandstay.com members are responsible for all aspects of the holiday home swap.
  
• Swapandstay.com is not responsible for the information provided by the members of Swapandstay.com
  
• Swapandstay.com will not be held legally responsible if a member submits false information in their membership application.
  
• Swapandstay.com will not be held responsible for damage to any property by its members.
  
• Swapandstay.com will not be held responsible or get involved in any disputes between members. Occasionally exceptional circumstances mean that holiday cancellation is unavoidable. It is the responsibility of the members involved to resolve the situation between themselves.
  
• Swapandstay.com will not be party to any contract or exchange of information between subscribing members. Any contract entered into is between the owners of the properties concerned.

Swapandstay's responsibility to its members.

Swapandstay.com takes all complaints against other members very seriously. Any member that has given false or misleading information about their property could end up losing their membership. If we have a minor complaint from another member, we will issue a warning to the member concerned. If we receive a second complaint after the warning, the membership will be terminated immediately and no refund will be paid.

Member's responsibilities.

As a Member of Swapandstay.com you agree to:

• Provide us with your full name, address and phone / fax numbers and email address, all of which should be kept current at all times.
  
  
• Update your listing as needed. Most important are your desired destinations, the dates your home is available and your desired swapping dates, which will let others know when and where you are looking to travel.
  
  
• Provide Swapandstay.com with an honest and accurate description of the property on your property listing page. All information provided in the property listings is the direct responsibility of the owner.
  
  
• Guarantee the accuracy of information in your property listing.
  
  
• Guarantee that you are the rightful owner of the property submitted for inclusion on Swapandstay.com.
  
  
• Guarantee that the photos are of your own property and that you have the publishing rights to the photos that are displayed in the property listing. Members agree that Swapandstay.com can use the photos for use on Swapandstay.com and in any other promotional capacity that we see fit.
  
  
• Provide genuine weekly rental rates that can be verified.
  
  
• Keep your holiday home well maintained and in good order.
  
  
• Supply your swapping partner with a comprehensive "guest file" that provides relevant property information i.e.- How everything works and who to contact if it doesn't, emergency contact numbers, local amenities etc. See Swapping Guidelines
  
  
• Members will respect each other's property and leave them in good condition. Any damages must be reported to the owner with an offer to reimburse the holiday home owner if required to do so.
  
  
• Members agree to abide by the maximum number of guests agreed with the holiday home owner at the time of arranging the swap.
  
  
• Members agree to honour any restrictions, rules and requests made by the holiday home owner in regards to the property.
  
  
• All members will ask for and offer references when swapping. It gives everyone peace of mind. A previous swapping partner or rental guest reference is best.
  
  
• You agree to suspend your listing to avoid further contact from potential swappers if you sell your holiday home. Your membership will still be available should you purchase another property.
  
  
• Members agree to act in an honest and responsible manner at all times.
  
  
• Members agree that all contact with other members will be for the express purpose of arranging a holiday home swap. Members will not use contact through Swapandstay.com membership for any other reason other than for arranging a holiday home swap.
  
  
• Spam will not be tolerated. Members agree not to use another members contact details for commercial or business use. Members agree not to pass on other member's details to a third party.
  
  
• Members take sole responsibility for any negotiations and agreements they may make with other members, all aspects of the holiday home swap and property listing information.
  
  
• Members agree that it is the responsibility of individuals to satisfy for themselves that the information provided in their swapping partners property listing is correct.
  
  
• Members agree not to use offensive language in their property listing or on the Members Forum.
  
  
• Members are responsible for the content displayed in their property listing.
  
  
• Membership is not transferable.
